1. Introduction and Scope
This Acceptable Use Policy (“AUP”) governs the use of SimpleTherapy, Inc.’s sports performance analysis platforms, applications, and services marketed under the ProPlayAI, HitAI and PitchAI brands (collectively, the “Services”). This AUP applies to all users, including teams, academies, coaches, trainers, athletes, parents/guardians, API integrators, and any other individuals or entities accessing the Services.
By accessing or using the Services, you agree to comply with this AUP. This AUP supplements and is incorporated by reference into the ProPlayAI Terms and Conditions. In the event of a conflict between this AUP and the Terms and Conditions, the Terms and Conditions shall control unless this AUP expressly states otherwise.
2. Permitted Uses
2.1 General Permitted Uses
The Services are designed for the following lawful purposes:
- Conducting video-based sports performance analysis and biomechanical assessments
- Analyzing pitching mechanics, throwing motion, and athletic movements
- Player development, training support, and performance improvement
- Injury risk assessment and prevention insights
- Return-to-play evaluations and progress tracking
- Generating reports, analytics, and insights for athletes, coaches, and training staff
- Integration with player management and training systems via authorized APIs
2.2 Product-Specific Permitted Uses

3. Video and Data Upload Requirements
3.1 Consent Requirements
Before uploading any video, image, or data depicting an identifiable individual to the Services, you must:
- Obtain valid, informed consent from the athlete (or their parent/legal guardian if under 18) for the specific purpose of the assessment
- Inform the individual how their data will be processed, stored, and used
- Maintain records of such consent as required by applicable law
- Comply with all applicable privacy laws in your jurisdiction
3.2 Minor Athletes
For videos or data depicting athletes under 18 years of age:
- Written consent must be obtained from a parent or legal guardian
- The assessment must serve a legitimate athletic development or training purpose
- Content must be appropriate and non-exploitative
- Coaches and teams are responsible for documenting and maintaining consent records
- You must comply with all applicable child protection laws, including COPPA where applicable
3.3 Video Quality and Technical Requirements
To ensure accurate analysis, uploaded videos should meet the following guidelines:
- Adequate lighting to clearly capture athletic movements
- Stable camera positioning at appropriate angles as specified in product documentation
- Athlete fully visible within frame throughout the recorded movement
- Supported file formats and resolution as documented for each product
4. Prohibited Conduct
You shall not, and shall not permit any third party to:
4.1 Unauthorized Access and Security Violations
- Attempt to gain unauthorized access to the Services, other accounts, or ProPlayAI systems
- Circumvent, disable, or interfere with security features or access controls
- Probe, scan, or test vulnerabilities without prior written authorization
- Share login credentials or allow unauthorized individuals to access your account
4.2 Reverse Engineering and Competitive Use
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Services
- Use the Services to develop, train, or improve competing products or services
- Systematically extract, scrape, or harvest data or content from the Services
- Benchmark the Services for competitive analysis without prior written consent
4.3 Harmful or Unlawful Content
- Upload content that is defamatory, obscene, threatening, harassing, or promotes violence
- Upload content depicting illegal activity or that violates the rights of others
- Upload videos of athletes without proper consent (or parental consent for minors)
- Upload malware, viruses, or other malicious code
- Use the Services for any purpose that violates applicable laws or regulations
4.4 Misuse of Outputs and Reports
- Remove, alter, or obscure any watermarks, branding, or proprietary notices
- Misrepresent outputs as certified medical diagnoses, clinical recommendations, or injury clearances
- Resell, redistribute, or sublicense reports or outputs without authorization
- Use outputs as the sole basis for medical treatment decisions, player eligibility, or contract negotiations without appropriate professional review
4.5 System Abuse
- Overload, disrupt, or impair the performance of the Services or underlying infrastructure
- Use automated systems (bots, scripts) to access the Services except through authorized APIs
- Exceed usage limits, rate limits, or quotas without authorization
- Interfere with other users’ access to or use of the Services
5. API-Specific Rules
If you have been granted API access, the following additional rules apply:
- Use the API solely for integration with your internal systems or authorized applications
- Comply with all rate limits, technical documentation, and usage policies
- Implement reasonable security measures to protect API credentials and tokens
- Do not share, publish, or expose API credentials
- Do not resell, redistribute, or sublicense API access without written authorization
- Ensure that any end-user facing application built on the API complies with this AUP
- Include appropriate attribution (“Powered by ProPlayAI”) where required
6. Output Usage Rights and Restrictions
6.1 Permitted Output Uses
Subject to your Terms and Conditions, you may:
- Use reports and analytics for internal coaching and training decisions
- Share reports with the assessed athlete (and their parent/guardian if a minor)
- Incorporate insights into player development and training programs
- Archive reports for player development tracking and historical comparison
6.2 Output Restrictions
You shall not:
- Publicly publish or distribute reports containing identifiable athlete data without consent
- Use outputs as the sole basis for medical treatment, return-to-play clearance, or roster decisions
- Modify reports in a way that misrepresents the analysis or findings
- Remove or alter “Powered by ProPlayAI” branding or watermarks without written authorization
7. Disclaimer of Professional Advice
THE SERVICES PROVIDE ANALYTICAL INFORMATION AND ASSESSMENTS ONLY. OUTPUTS DO NOT CONSTITUTE AND SHALL NOT BE RELIED UPON AS: MEDICAL ADVICE OR CLINICAL DIAGNOSIS; ATHLETIC TRAINING PRESCRIPTIONS; INJURY CLEARANCE OR RETURN-TO-PLAY DECISIONS; OR ANY OTHER FORM OF PROFESSIONAL RECOMMENDATION. Users are solely responsible for decisions made based on information provided by the Services and should consult qualified medical professionals, athletic trainers, and coaches as appropriate.
8. Enforcement and Consequences
8.1 Monitoring
ProPlayAI reserves the right to monitor use of the Services to ensure compliance with this AUP. Such monitoring may include reviewing usage patterns, investigating reports of violations, and taking appropriate action.
8.2 Violation Response
If ProPlayAI determines, in its sole discretion, that you have violated this AUP, ProPlayAI may:
- Issue a warning and request corrective action
- Temporarily suspend access to the Services
- Permanently terminate access without refund
- Remove or disable access to content that violates this AUP
- Report violations to law enforcement or regulatory authorities as required or appropriate
8.3 No Liability
ProPlayAI shall not be liable for any damages arising from enforcement actions taken in good faith under this AUP.
9. Reporting Violations
If you become aware of any violation of this AUP, please report it to: abuse@proplayai.com. ProPlayAI will investigate all credible reports and take appropriate action.
10. Changes to This Policy
ProPlayAI may modify this AUP from time to time. Material changes will be communicated via email or through the Services with at least fourteen (14) days’ notice prior to the changes taking effect. Continued use of the Services after such notice period constitutes acceptance of the modified AUP.
